Can a Sham Marriage Affect Your UK Visa Application?

A sham marriage can have consequences beyond the immigration application in which it was first identified. Under UK immigration law, the Home Office may refuse future visa applications or cancel existing immigration permission where an individual has been involved in a sham marriage or civil partnership.

However, an allegation alone is not sufficient to establish a sham marriage. The Home Office must assess the evidence and determine whether the legal requirements for refusal or cancellation have been met.

What Constitutes a Sham Marriage Under UK Immigration Law?

Sections 24 and 24A of the Immigration and Asylum Act 1999 set out the statutory definition of a sham marriage or civil partnership.

A marriage may fall within this definition where one or both parties are not relevant nationals, there is no genuine relationship between them and one or both entered the marriage to circumvent UK immigration controls.

Such arrangements may involve individuals marrying primarily to obtain an immigration advantage rather than establish a genuine marital relationship.

However, a relationship that does not meet the evidential requirements of a particular visa route is not necessarily a sham marriage. The Home Office must establish the relevant statutory elements before reaching such a finding.

Can the Home Office Refuse a Visa on Sham Marriage Grounds?

Under paragraph SUI 8.1 of Part Suitability, the Home Office may refuse an immigration application where the applicant is, or has previously been, involved in a sham marriage or civil partnership.

Paragraph SUI 8.2 also permits the cancellation of existing immigration permission.

Both provisions are discretionary. Therefore, even where involvement has been established, the Home Office must consider whether refusal or cancellation is appropriate in the individual circumstances.

How Does the Home Office Establish a Sham Marriage?

The Home Office may investigate suspected sham marriages through immigration applications, marriage referral procedures or information obtained during immigration enforcement activities.

Its assessment may consider the circumstances surrounding the marriage, the nature of the relationship and evidence suggesting an intention to circumvent immigration controls.

Suspicion alone is insufficient to establish involvement.

The Home Office must demonstrate, on the balance of probabilities, that the applicant was involved in a sham marriage or civil partnership.

Can a Previous Sham Marriage Finding Affect Future Visa Applications?

A previous finding may remain relevant to subsequent immigration applications.

Paragraph SUI 8.1 expressly applies to individuals who are, or have previously been, involved in a sham marriage or civil partnership.

A previous finding may therefore affect future UK visa applications, including those made under a different immigration route, where the relevant suitability provisions apply.

However, the Home Office must consider the applicant’s individual circumstances when exercising its discretion.

Its guidance also recognises that taking action against someone who was deceived about the relationship or forced into marriage is unlikely to be appropriate.

Does a Sham Marriage Finding Lead to a 10-Year UK Entry Ban?

A sham marriage finding does not automatically result in a 10-year mandatory refusal period.

Under SUI 8.1 and SUI 8.2, involvement in a sham marriage constitutes a discretionary ground for refusal or cancellation.

However, where deception has been established in a previous immigration application, a 10-year mandatory refusal period may apply under SUI 11.4(d) and SUI 12.1(f), subject to the relevant provisions of the Immigration Rules.

A sham marriage finding and a finding of deception are separate legal matters.

Conclusion

A sham marriage finding can have lasting consequences for an individual’s immigration position, including future applications under different visa routes.

Nevertheless, the Home Office must establish involvement through sufficient evidence and exercise its discretion in accordance with the Immigration Rules.

Importantly, a sham marriage finding does not automatically result in a 10-year refusal period. Separate legal provisions apply where deception has been established.

Applicants facing such allegations should carefully examine the grounds of the Home Office’s decision and obtain professional advice before submitting a further application.
