UK: New Statement of Changes to Immigration Rules

The Home Office has issued a Statement of Changes to the UK Immigration Rules on 15th of March 2022. This includes updates on immigration and Global Business Mobility Routes.

Following are the key points:

Foreign businesses can start sponsoring foreign nationals and their families through five subcategories of the new Global Business Mobility route. This route will help foreign businesses to establish a presence in or relocate staff to the United Kingdom from 11th of April 2022 onwards. Before any of the applications may be processed, a sponsor licence must be secured.

Specialist or Senior WorkerThis subcategory is for a replacement of Intra-company transfer (ICT) route and is for foreign citizens who will be working in U.K temporarily for a connected group company.  
Graduate TraineeThis subcategory replaces Intra-company -graduate transfer (ICT) trainee and is for the foreign workers who are completing a work placement at a UK Limited company as part of a graduate training course in preparation for a role as a specialist and senior management outside the UK.  
Expansion WorkerThis subcategory is for foreign workers who will be working as a specialist and senior manager in United Kingdom temporarily for the purpose of establishing a branch of their foreign company.
Service SupplierThis subcategory is intended for foreign workers who are undertaking assignments in U.K on temporary basis, where employer is either a contractual service supplier employed by foreign service provider, or a self-employed independent professional based overseas, and they need to undertake an assignment in U.K in order to provide services that are covered by one of the international trade commitments of U.K. 
Secondment WorkerThis subcategory is for the foreign citizens who are temporarily working in the United Kingdom as a part of a high investment or high-value contract by a foreign-owned corporation.  

Applicants for the Global Business Mobility route can also apply for their dependent children and partner. The Global Business Mobility route’s subcategories do not give settlement options or permanent residence. On 30th of May 2022, the United Kingdom will introduce a new High Potential Individual route, as well as a new Scale-up Visa on the 22nd of August 2022.

High Potential Individual (HPI) route is for the students who will be graduating from “Top Global Universities.” In the last five years, applicants must have completed an eligible study of course equivalent to bachelor’s degree level of UK or above. For these recently graduated applicants there will be no job offer requirement. Also, they will be able to work in UK and they will also be allowed to bring their family with them.

Scale-up Visa will open on August 22,2022 and it will be intended for people who are recruited by a U.K scaleup sponsor who have a good and skilled job offer from a reputable and qualifying scale-up business. There will be an English language requirement for this as well. For their particular role this will either be the going rate or the general salary threshold of either £10.58 per hour or £33,000 per year.
