Visas that allow you to settle in the UK

Indefinite Leave to Remain (ILR) gives you the right to live, work, and study in the UK without time limits. It’s a vital step if you plan to stay in the UK permanently or apply for British citizenship. There are several routes to qualify based on your visa type, family ties, and how long you’ve lived in the UK.

Settlement with a Work Visas

You can apply for ILR if you’ve been working in the UK for a qualifying period on an eligible visa. This includes the Skilled Worker, Health and Care Worker, Tier 2 (General), Innovator Founder, and Global Talent visas. The qualifying period is usually 5 years, though it may be shorter (2–3 years) for some visas like the Global Talent or Tier 1 Investor (category closed). You’ll need to meet salary and continuous residence requirements.

Settlement with A Family Visa

If you’re living in the UK with a partner, child, or parent who is a British citizen or settled, you may be able to apply for ILR. Most partners qualify after 5 years of living together in the UK on a family visa. Some may qualify sooner, such as bereaved partners or those leaving abusive relationships. Your relationship must be genuine and ongoing, and you must meet residency and English language requirements.

Settlement with A Long Residency Visa

If you’ve lived legally in the UK for 10 continuous years on any combination of valid visas, you may qualify for ILR under the long residence route. You must not have broken your stay, and there are limits on how much time you can have spent outside the UK. This route is ideal for those with varied immigration history but a stable long-term presence in the UK.

Settlement with A Private Life Visa

This route is for individuals who have lived in the UK for a long time without immigration status or with limited leave. If you’re over 18 and have lived continuously in the UK for 10 years, or you’re under 18 and have lived here for at least 7 years, you may qualify. The application focuses on your personal ties and integration into UK life.

Settlement with Ancestry Visa

If you’re a Commonwealth citizen and have a UK Ancestry visa, you can apply for ILR after 5 years of continuous residence. You must be working or able to work, show you can support yourself, and prove your UK-born grandparent connection. This is a popular route for those with strong historical family ties to the UK

Settlement with EU Scheme

If you’re from the EU, Switzerland, Norway, Iceland, or Liechtenstein and started living in the UK before 31 December 2020, you may apply for settled status under the EU Settlement Scheme. After 5 years of continuous residence, you can gain ILR-equivalent status, known as “settled status.” This also applies to eligible family members.

Settlement for Returning Residence

If you previously had Indefinite Leave to Remain and have been away from the UK for more than 2 years, you may be able to return and regain your status as a returning resident. You’ll need to show strong ties to the UK and your intention to live here permanently.
