What are the compliance duties for a Sponsorship Licence?

Compliance duties for sponsors are Monitoring immigration status and preventing illegal employment, maintaining migrant contact details and other records, Monitoring and reporting migrant activity, ensuring that relevant professional registrations and accreditations have been obtained, reporting various changes of circumstances to the sponsor, complying with the law, including employment law and having relevant planning permission and Cooperating with the Home Office.

What are the general requirements for a Skilled Worker Sponsor Licence?

The sponsoring companies will need to ensure in their visa application that:

  • They are a genuine organisation operating lawfully in the UK.
  • The authorising officer for the sponsoring company is honest, dependable, reliable and are not engaging and have not engaged in behaviour or actions that are not conducive to the public good.
  • They can carry out their sponsor duties and evidencing their compliance in a timeframe and manner set out in sponsor guidance.

What happens during a Home Office Sponsor Compliance Audit or Visit?

During the visit, the officers will check if:

  • Information that has been submitted to UKVI is accurate and absolute
  • The company or business can offer employment at the relevant skill level
  • The company is genuine and trading or operating lawfully in the UK
  • There are no reasons to believe that the company represents a threat to immigration control
  • The company is committed to complying with all the duties of sponsorship

Are Home Office Compliance visits announced?

The Home Office may check sponsors at random. These visits can be announced or unannounced.

What happens after the Home Office Compliance audit?

If the compliance officers discovers a problem before making a decision on the sponsor licence application, the application may be refused.

Alternatively, If the compliance officers find discrepancies with the compliance of the licence during an audit, actions will be taken against the licensed business. This could lead to their licence being revoked, suspended, or downgraded, with repercussions for sponsored employees.

The discrepancies are with the Compliance of the Licence during an Audit from a Compliance Officer “not with the application” 

What happens if a company or business receives a civil penalty?

The Home Office will send a notice telling the licence holder that their case is being referred to officials who will consider their liability for a civil penalty
